Grievance Information

If you feel you have been treated unfairly in any way, you have the right to file a grievance.

Follow these simple steps:

  1. First, talk to your immediate supervisor and try to resolve the issue. If this doesn't help, go to step 2.
  2. Fill out a Statement Of Occurrence form and turn it over to a steward in your department or call the CWA Union Office at (386) 761-3102 on any Thursday. Someone will be in touch with you as soon as possible.
  3. Always ask for a Union Representative when you go into a meeting with management and you think it is for disciplinary action. You have the right to have a Union Representative present - but you have to ask for one. This is the Law! The company will not and is not required to offer you a Representative.
  4. Never, Never, sign anything. Once you do, it makes things very difficult to resolve and makes it impossible to get your job back in many cases.
  5. If you are ever called into a meeting with a representative or manager of your company's Security, ask for a Union Rep immediately - even if you are told you don't need one. You definitely need representation. During this meeting, give short answers to what is asked. Don't volunteer more information than requested. After you have made a statement, you may be asked to read and sign the statement - Don't! Decline and leave once the meeting is over.
  6. Follow any other directions given by your steward.

You are entitled by law to union representation. Don't be misled into thinking you won't need it!

If called into a meeting with management, read the following to them before the meeting starts:

"If this discussion could in any way lead to me being disciplined or terminated, or affect my personal working conditions, I respectfully request that my union representative, officer, or steward be present at this meeting. Without representation present, I choose not to participate in this discussion."

* You must request Union Representation, the Company doesn't have to offer it. *

  1. You do not have to write or sign any statement for the Company. (If you do, request a copy).
  2. If the Company request you sign a document, put something like I don't understand or I don't agree or something similar to prevent the company from sneaking unsigned documents in your file at a later time.
  3. When asked a question by the Company, if you don't recall, say you don't recall. (Don't try to fill in the gaps or guess).
  4. You have the right to information regarding the subject of the meeting before you participate.
  5. You have the right to consult with your Union Representative before and/or during the meeting.
  6. You must request Union Representation, the Company doesn't have to offer it.

 Not getting called out?

You are entitled to penalty pay in the amount of 4 hours premium pay if you are passed over for OT.  They have to call your phone on record when you are off and if they don't need everyone, they should be using the OT list that is posted at your work center. 

It has been a regular occurence lately and if it happens to you, file a grievance.  It's the only way to get the company to honor your contractual rights.

And check your paystubs when you prevail.  There is an option for penalty pay that shows up as 3 hours straight pay.  THIS IS WRONG!!!  Notify your supervise and have him correct it immediately.

Sign or not to sign 

You do not have to sign anything.

I have heard of the company using your signature as an argument that you agreed with their position. I recommend that you acknowlege items covered with your initials and the date ONLY!!

Having said that, there are instances where your signature really doesn't matter and you can sign without fear of recourse. That would be things like FORMAL training classes where it shows you were in attendance. But read before you sign.

Filing a grievance


The rule of thumb in filing a grievance is "keep it simple."  You don't have to explain the entire problem you're having when you fill out the grievance form.

One example would be: I was not scheduled per my preferences

Another would be:  I was put on RSSM and I don't agree.

You can fax your grievance to the hall at 386 788-8088

When we get the grievance form, we will contact you and ask the questions we need to proceed.  If you have documentation to help prove your position, this is the time to share it with us.

New Stewards!! 


Training was completed for 3 mobility employees; Phil Farruggio (ISB), Bryan Oliver (ISB), and Steven Torres (Orange City).

I would like to thank these gentlemen for stepping up and standing up!!!  We desperately need all of you!
